Terms of Service

Terms overview

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Kordra website and application (the "Service") operated by Godsall.Dev ("us", "we", or "our"), trading as Kordra.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

3. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Godsall.Dev and its licensors. User Content: You retain all intellectual property rights to the lyrics, audio, and song structures you create using our Service. By submitting prompts or content to the Service, you grant us a temporary, non-exclusive, royalty-free license solely for the purpose of operating the Service and generating your requested outputs.

4. Subscription and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually). Billing is handled securely via Stripe. All prices are inclusive of VAT where applicable.

5. Cancellation and Refunds

5.1. Statutory Right of Withdrawal & Digital Content Waiver

Under UK consumer law, you normally have a 14-day right to cancel a contract for online services. However, because Kordra provides immediate access to digital content, this rule applies differently. During the checkout process, you will be asked to expressly consent to receiving immediate access to the Service. By providing this consent, you acknowledge and agree that you waive your 14-day statutory right to cancel and claim a refund.

5.2. General Refunds

Because you receive immediate access to our digital content, all Subscription fees are non-refundable unless the Service is defective (as outlined in Section 7). You may cancel your Subscription at any time via your account settings. Cancellation will prevent future billing, but you will continue to have access to the Service until the end of your current paid billing cycle. No partial refunds are provided for unused time.

6. Termination

6.1. Termination for Breach

We may terminate or suspend your access to our Service immediately, without prior notice or liability, if you breach these Terms (e.g., fraudulent payment, abuse of the platform). In this event, no refunds will be issued.

6.2. Termination without Cause

We reserve the right to discontinue the Service or terminate your account for business reasons. If we terminate your active, paid Subscription without cause, we will provide you with a pro-rata refund for the remaining unused days in your current billing cycle.

7. Limitation of Liability and Statutory Rights

7.1. Exceptions

Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be legally excluded or limited under English law.

7.2. Defective Digital Content

Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose, and as described. If our Service is defective and damages a device or digital content belonging to you as a result of our failure to use reasonable care and skill, we will either repair the damage or pay you compensation.

7.3. General Limitation

Subject to Section 7.1 and 7.2, Godsall.Dev shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.

8. Changes to Terms

We reserve the right to modify these Terms at any time. If a revision is material (such as a price increase or a significant reduction in features), we will provide you with at least 30 days' written notice via email before the new terms take effect. If you do not agree to the new terms, you may cancel your subscription before the changes come into force.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales, although if you are a resident elsewhere in the United Kingdom, you may bring proceedings in your local courts.
